Fair Usage Policy
China Unicom (Hong Kong) Operations Limited
Policy objective
In order to meet customers’ growing demand for mobile data usage, China Unicom Hong Kong will strive to enhance the quality of telecommunications services. However, China Unicom Hong Kong network bandwidth is shared among all customers, high usage clients or customers using high- bandwidth applications such as point to point service (Peer-to-Peer services) and network sharing (Tethering) will occupy more network resources, which may affect other customers. In order to ensure that each customer is able to access to mobile data services in a fair and reasonable manner without affecting other users, and to safeguard the stability and security of China Unicom Hong Kong network, China Unicom Hong Kong has formulated the Fair Usage Policy. It is intended to ensure all customers shall have a fair opportunity to access to mobile data services.
Policy implementation
2.1 When a customer enters into the "Mobile Communication Service Application Form", " Terms and Conditions of China Unicom Hong Kong Mobile Communications Services " and other ancillary documents (the "Service Agreement ") with China Unicom Hong Kong, China Unicom Hong Kong will, according to customer's selected service plan, the charge limit to relevant mobile data and the relevant value-added services, apply and stipulate a “Fair Usage Data Threshold” to the customers' respective selected service contracts.
2.2 During the period from 00:00 on the 1st day to 23:59 on the last day of each calendar month ( the "Monthly Service Cycle " ), once the aggregate relevant Hong Kong data usage of a customer reaches the relevant Fair Usage Data Threshold applicable to the customer’s selected service plan, customer is still accessible to mobile data services, but China Unicom Hong Kong have the right to control the data transmission speed (upload and download) at a level not lower than 128kbps, and restrict the use of point to point service (peer-to-peer services) and network sharing (tethering) function. The aforesaid control measures will be released at the beginning of the next Monthly Service Period.
2.3 Due to certain uncontrollable factors to China Unicom Hong Kong, including but not limited to the power or function of customer's device, transmission technology, network condition, speed and capacity of network server, suspension of service of other suppliers or content providers, failure of other communication network, climate effect, radio interference caused by physical blockage such as mountain, sea tunnel etc., no warranty of actual transmission speed (upload and download) during usage by customers is given by China Unicom Hong Kong.
Application and Amendment
3.1 This principle applies to all customers using China Unicom Hong Kong personal telecommunications services. Any discrepancies in this principle with the terms and conditions of relevant service contract, the related part or term of the relevant service contract prevails.
3.2 China Unicom Hong Kong reserves the right to revise the terms and conditions of this Fair Usage Policy from time to time. The amendments will be informed to the customers in a reasonable manner not less than 30 days before the amendments come into force, and the newly revised provisions of Fair Usage Policy and the effective date will be announced in China Unicom Hong Kong website (https://www.cuniq.com ).
